What does Change of Status mean?

What does Adjustment of Status mean?

The term “Adjustment of Status” refers to applying for permanent residency (green card) within the United States. The approval of the application can take between one year and several years. In some cases, a face to face interview is required. This is often done in marriage-based green card applications to ensure that the marriage is bona fide.

How long does it take to get a green card?

There are various ways to get a green card. The timeline for each pathway is different. Depending on the pathway, the process can take 1 to 3 years. Yearly caps and location of the processing office should also be taken into the consideration.

What is “Presidential Proclamation suspending entry of foreign nationals that present a risk to the United States labor market”?

President Trump issued a Proclamation suspending entry into the United States for certain employment based non-immigrant visa holders such as H-1B, H-2B, J-1 with some exemptions and L-1. It is effective from June 24, 2020 through December 31, 2020 with certain exceptions. The Proclamation also extends the duration of the suspension concerning entry of some immigrants introduced in the earlier Proclamation 10014 which was effective as of April 23, 2020.

What is the minimum investment amount for EB-5 Immigrant Investor Visa?

The standard minimum investment amount increased from $1 million to $1.8 million. The new rule also keeps the 50% minimum investment differential between a Targeted Employment Area (TEA) and a non-TEA, therefore increasing the minimum investment amount in a TEA from $500,000 to $900,000. The new rule also reforms the TEA designation process. Specifically, the Department of Homeland Security is now authorized to make such designations directly instead of the states.
